ORDINANCE 98-07-01

AN AMENDMENT TO SECTION 6-49 OF THE
GENERAL ORDINANCES OF THE TOWN OF KENTLAND

WHEREAS, General Ordinance No. 40, 18 as enacted by the Board Of Trustees in 1940, and as codified as section 6-49 of the General Ordinances of the Town Of Kentland in July, 1983 prohibits Nuisances from being erected, maintained, continued or established; and

WHEREAS, Ordinance No. 6-49 provides a line not exceeding ten dollars ($10.00) for anyone convicted of violating this section; and

WHEREAS, due to economic changes the Town Council feels it is necessary to ilicrease the amount of the aforementioned monetary fine to a sum not to exceed one hundred dollars ($100.00) to create a reasonable financial deterrent to would be offenders; and

WHEREAS, the Town Council deems it necessary to provide a recurring fine to induce any person convicted of violating this section to eliminate the violation as soon as possible in order to minimize the injury, annoyance or hurt of any part of the citizens of the Town of Kentland;

NOW, THEREFORE, be it duly ordained as follows: Section 6-49 of the General Ordinances of the Town Of Kentland concerning Nuisances in General is hereby amended to read as follows:

 Sec. 649 Nuisances in General.

Every person who shall erect, maintain, continue or establish any public nuisance to the injury, annoyance, or hurt of any part of the citizens of the Town shall upon conviction thereof be fined a sum not to exceed one hundred dollars ($100.00) at the time of conviction and shall be fined a recurring fine of twenty dollars ($20.00) per day for each day that the violation continues after conviction.

This amendment shall become effective immediately after publication in the Newton County Enterprise for two (2) consecutive weeks.

All of which is duly ordained this 14th day of July 1998.
