ORDINANCE 98-07-04
AN AMENDMENT TO SECTION 8-25 OF THE
GENERAL ORDINANCES OF THE TOWN OF KENTLAND
WHEREAS, General
Ordinance No 6-1-59 as enacted by the Board Of Trutees as codified as
Section 8-25 of the General Ordinances
of the Town Of Kentland in July 1983, places restrictlons on speed Iimits
of motor vehicles within the Town of Kentland; and
WHEREAS, the Town Council desires to amend Ordinance
8-25 to include Princeton Parkway between First Street and Fourth
Street: and
WHEREAS, the Town Council deems it necessary for the safety of
the citizens of the Town of Kentland and those utilizing the Cast Park
Facilities to limit the speed of vehicular traffic on Princeton Parkway
and to create a monetary fine that would serve as a reasonable deterrent
to violating the ordinance;
NOW, THEREFORE, be it duly ordained as follows: Section 8-25,
paragraph (p) through (s) of the General Ordinances for the Town of Kentland
concerning Speed Limits is hereby amended to read as follows:
Section 8-25
(p) The speed limit for Princeton Parkway between
First Street and Fourth Street shall be 40 miles per hour.
(q) Any person who violates any of the provisions
of this Section shall, upon conviction or a plea of guilty, be subject
to a fine or penalty of forty dollars ($40.00).
(r) The Town Marshal and all other duly authorized
law enforcement officers charged with the enforcement of this Section
may issue an appearance ticket directing said offender to appear before
the Clerk-Treasurer of the Town Of Kentland by a specified date. Anyone
so notified to appear for a violation of this Section may pay the
fine or penalty of forty dollar5 ($40.00) direct to the Clerk-Treasurer
of the Town, who shall give the offender a receipt showing payment
thereof. If said alleged offender does not wish to admit a violation
of this section and voluntarily pay the penalty to the Clerk-Treasurer,
then charges shall be preferred by the arresting officer for the violation.
(s) All funds collected under this Section by the
Clerk-Treasurer shall be duly recorded in a separate record book and
all money collected shall be turned into the General Fund of the Town
Of Kentland.
This amendment to Ordinance 8-25 shall become effective immediately after
publication in Newton County Enterprise for a period of two consecutive
weeks.
