CHAPTER 8 - TRAFFIC AND PARKING REGULATIOINS

Article 1 Bicycles

Sec. 8-1     Definition

A bicycle shall be defined as any foot-propelled vehicle, irrespective of the number of wheels it has in contact with the ground.1


Sec. 8-2    Governed by State Law

Operators of bicycles, when on a public street, road, or highway, within the Town, shall conform to the rules and regulations established for the operation of motor vehicles.


Sec. 8-3    Obedience to Traffic-Control Devices

Operators of bicycles, shall obey the directions an instructions of official traffic-control devices and signals applicable to vehicles, unless otherwise directed by a police officer.


Sec. 8-4    Riding on Sidewalks Prohibited

It shall be unlawful for any person or persons to ride any bicycle or tricycle upon any public sidewalk in the Town.

Sec. 8-5    Racing Prohibited

It shall be unlawful for any person or persons to speed or race on any bicycle or tricycle on any street in the Town.

Sec. 8-6    Penalties

Any person violating Sections 8-4 or 8-5 shall, upon conviction, be fined not less than three ($3.00) dollars nor more than ten ($10.00) dollars for each and every such offense.


Sec. 8-7    Bicycle Parking

Areas painted yellow shall be restricted for bicycle parking.

Sec. 8-8 - 8-10 Reserved for Future Use

 

Article 2 - Erection and Designation of Stop Signs, Yield, Right of Way Signs, and Do Not Enter Signs

 

Sec. 8-11    Stop Signs

(a) Every operator of a vehicle shall observe all "stop" signs and signals erected by the Town.

(b) The Town Board of Trustees believes that it is in the interest of public safety and for the general welfare of the public to install stop signs at the following locations:

(1) A four-way stop sign mounted on wheels shall be at the intersection of North First Street and Graham Street near the Grade School entrance during the following hours:

7:30 a.m. to 8:30 a.m.; 10:45 a.m. to l: 00 p.m.; 2:50 p.m. to 3:45 p.m. and only on days which the school is in session

(2) East and West terminals of Holley Drive, being First and Fourth Street;

-Second Street entering Holley Drive;
-Second Street entering Maple Street;
-Third Street entering Holley Drive;
-Third Street entering Maple Street

(3) At the following intersections:

-On Wilson Street at Fairground Street,
-On Fallon Street at U.S. Road No. 24, and
-On Lutz Street at U.S. Road No. 24

-For the east and westbound traffic on Lincoln Street at the intersection of Lincoln and Second Streets in the Town of Kentland,

-For the north and southbound traffic on First Street at the intersection of First Street and Ray Street in the Town of Kentland,

-For the eastbound and westbound traffic on Holley Drive at the intersection of Third Street and Holley Drive in the Town of Kentland.

Sec. 8-12    Yield Right of Way Signs

(a) Every operator of a vehicle shall observe all "yield" signs erected by the Town.

(b) The Town Board of Trustees believes that it is in the best interest of safety and for the general welfare of the Public to install "Yield" signs at the following locations:


Sec. 8-13    Do Not Enter Signs

(a) Every operator of a vehicle shall observe all "Do Not Enter" signs erected by the Town.

(b) The Town Board of Trustees believes that it is in the interest of public safety and for the general welfare of the public to install "Do Not Enter" signs at the following locations:


Sec. 8-14    Miscellaneous Public Safety Signs

(a) The State of Indiana has adopted a Resolution for a "25 MPH WHEN CHILDREN PRESENT" sign for the U.S. 24 crossing. (3-8-76 Town Board of Meeting)

Article 3 - No Parking and Restrictive Parking Regulations


Sec. 8-18    Parking Prohibited and Grass

(a) Parking is prohibited on the grass in all Town Parks.

(b) All areas shall be marked by "No Parking" signs.

(c) Violators shall be issued a warning ticket for the first offense.

Sec. 8-19    Restricted Parking Near State Highways

(a) Pursuant to the Statutes of the State of Indiana relative to traffic regulation, the Indiana State Highway Commission has the authority and the duty to adopt and promulgate regulations in the interest of the safety and convenience of the traveling public using the highways, including streets in cities and towns, under the control of said Commission.

(b) The following Resolution was passed by the Indiana State Highway Commission:

(1) Parking shall be restricted on U.S. 41 in the Incorporated Town of Kentland, Newton County, as follows:

"NO PARKING ANYTIME" on both sides of U.S. 41 from a point 150 feet north of the centerline of U.S. 24 to a point 2250 feet north of the centerline of US 24, a distance of approximately 2100 feet .

Sec. 8-20    No Parking From Here to Corner

The Town Board of Trustees believes it is in the interest of public safety to install "no parking from here to corner" signs at the following locations:

(1) On the west side of North First Street approximately fifty feet (50) south of the entrance to the Grade School.

Sec. 8-21    Limited Parking Streets

Ordinance 2-10-98 Regarding Parking on Dunlap Street

(a) Definitions: Limited Parking Streets are streets where no motor vehicle shall park at or in any specified places or locations, and it shall he unlawful for any person to park, or cause to be parked, any motor vehicle at or in any of the specified places or locations, for a period in excess of two (2) hours, between the hours of 7:00 a.m. and 5:00 p.m. on any day of the week, excluding Sunday.

(b) Designation of Limited Parking Streets: The following streets, or parts thereof, are designated Limited Parking Streets:

(1) Third Street from the center of Seymour Street, and extending on the east and west sides thereof to Graham Street, and all of the west side of Third Street extending from Graham Street to Dunlap Street, both inclusive.

(2) The north and south sides of Graham Street, between Second and Third Streets.

(3) The South side of Graham Street, between Third Street and the west side of the Post Office, both inclusive.

(c) Penalties:

Ordinance 98-07-02 Amendment to 8-21(c)

(1) Any person parking in excess of two (2) hours at any of places designated in Sub-section (b), between the hours of 7:00 a.m. and 5:00 p.m. shall be fined in the sum of two dollars ($2.00) for each and every violation.

(2) Any person parking in excess of two hours at any of the designated places, in Sub-section (b), at the times stated, may avoid court costs by paying to the Town Clerk-Treasurer of the Town of Kentland, Indiana, within four (4) hours after notification by any enforcement officer, the sum of two dollars ($2.00) and receive the due and legal receipt from the Town Clerk-Treasurer. Sum or sums so collected shall be credited by the Town Clerk-Treasurer to the Street Fund of the Town of Kentland, Indiana.

(d) No vehicles shall park on the south side of Graham Street in front of the Post Office for a period of time to exceed ten (10) minutes and any person violating the provisions of this Sub-section shall be fined as provided in Sub-section (c) of this section.

Sec. 8-22    Limiting the Parking of Trucks, Trailers, Tractors, Tractor-Trailers, and House-Trailers.

Amendment to Section 8-22 Passed 8-9-93

(a)    It shall be unlawful to park any truck, trailer, tractor, tractor-trailer or house-trailer along and upon either side of Seymour Street in the Town between First Street and Fourth Street of the Town at any time for a period in excess of two (2) hours, or along or upon the public parking space or grounds of said Town lying adjacent to said Seymour Street and upon the south side thereof between First Street and Fourth Street in said Town for a period in excess of two (2) hours.

(b)    It shall be unlawful for any person operating a motor truck, to stop and receive or discharge any commodities, or goods, wares and merchandise of any kind whatever, on Third Street in the Town, between Graham Street and Seymour Street in the Town; and it is further declared to be unlawful for any person operating a motor truck to park any such motor truck on Third Street in the Town between said Graham and Seymour Streets.

(c)    Any person violating any of the provisions of this Section shall be fined in a sum not to exceed ten dollars ($10.00) for each offense.


Sec. 8-23    Parking Restriction on Certain Streets

(a)    Except as otherwise provided, it is hereby declared to be unlawful for any person to park or leave standing, any motor vehicle on the following designated parts of Third, Dunlap, and Graham Streets in the Town of Kentland; provided that in traveling South on Third Street between Dunlap and Seymour Streets, such motor vehicle may be parked by heading to the West curb at an angle of thirty degrees; in traveling North on Third Street between Dunlap and Seymour Streets, any such motor vehicle may be parked by heading to the East curb at an angle of thirty degrees; in traveling east on Dunlap Street, between Third and Fourth Streets, any such motor vehicle may be parked by heading to the South curb at an angle of thirty degrees; in traveling West on Dunlap Street, between Third and Fourth Streets, any such motor vehicle may be parked parallel with the North curb; in traveling East on Graham Street, between Second Street and the East Line of the Arcade Hotel, any such motor vehicle may be parked parallel to the south curb; and on said Graham Street from the East Line of the Arcade Hotel to Fourth Street, any such motor vehicle may be parked by heading to the South curb at an angle of thirty degrees; in traveling West on Graham Street, between Fourth and Second Streets, any such motor vehicle may be parked by heading to the North curb at an angle of thirty degrees; provided further; automobiles may be parked in the center of Third Street between Dunlap and Graham Streets and in the center of Graham Street, between Third and Fourth Streets in any manner to be designated by the Town Marshal.

(b)    It is hereby declared to be unlawful for any person operating a "Trailer", "Semi-Trailer", "Motor Truck", "Auto Bus"', "Tractor", or "House Car" as defined by State law to park any such motor vehicle on Third Street, between Graham an Seymour Streets, or to stop and receive or discharge any commodities, or goods or wares and merchandise, or passengers, on the designated part of Third Street.

(c)    Any person violating any of the provisions of this Section, shall, upon conviction, be fined in any sum not less than five dollars ($5.00) nor more than ten dollars ($10.00) for each such offense.

Sec. 8-24    Double Parking Regulations

(a)    It is UNLAWFUL for any person to park a motor vehicle or to leave such motor vehicle without an attendant, on any of the streets of the Town of Kentland, double parked, or parked in such a manner that there is a motor vehicle, or insufficient space therefor, separating any such motor vehicle from the curb or curb line of the street, for a period of time exceeding TEN (10) MINUTES

Sec. 8-25    Designation of Through or Preferential Streets and Speed Limits.

(a)    Seymour Street (U.S. Highway 24) and U.S. Highway 41 are hereby determined and declared to be "through" or "preferential" streets. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" streets, and to yield the right of way to the traffic on the "through" or "preferential" streets.

(b)    The portion of First (1st) Street between Owen Street and Seymour Street; and between Seymour Street and Lincoln Street; and between Lincoln Street and the North Corporate Limits of the Town of Kentland is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring the motor vehicle, bicycle, or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(c)    The portion of Second (2nd) Street between Owen Street and Seymour Street; and between Seymour Street and Lincoln Street; and between Lincoln Street and Maple Street is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(d)    The portion of Third (3rd) Street between Owen Street and Seymour Street; and between Seymour Street and Dunlap Street; and between Dunlap Street and Lincoln Street; and between Lincoln Street and Maple Street is hereby determined and declared to be a "through" or "preferential" Street. Any person driving or operating a motor vehicle, bicycle, or other conveyance to come to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(e)    The portion of Fourth (4th) Street between Owen Street and Seymour Street; and between Seymour Street and Lincoln Street; and between Lincoln Street and the North Corporate limits of the Town of Kentland is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance or any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(f)    The portion of Fifth (5th) Street and Seymour Street and Dunlap Street is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(g)    The portion of Sixth (6th) Street between Seymour Street and Dunlap Street, and between Dunlap Street and Lincoln Street; and between Lincoln Street and the end of said North Sixth (6th) Street is. hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to traffic on the "through" or "preferential" street.

(h)    The portion of Ade Street between Lincoln Street and the end of said Ade Street is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to traffic on the "through" or "preferential" street.

(i)    The portion of Owen Street between First (1st) Street and Third (3rd) Street; and between Third Street and the East Corporate limits of the Town of Kentland is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(j)    The portion of Allen Street between the West Corporate limits of the Town of Kentland and First Street is hereby declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(k)     The portion of Water Street between Railroad Avenue and Allen Street is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(1)    The portion of Dunlap Street between Fourth (4th) Street and U.S. Highway 41 is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(2)    The portion of Lincoln Street between First (1st) Street and Fourth (4th) Street; and between Fourth (4th) Street and U.S. Highway 41 is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way to the traffic on the "through" or "preferential" street.

(n)    Maple Street between Fourth (4th) Street and the West end of said Maple Street is hereby determined and declared to be a "through" or "preferential" street. Any person driving or operating a motor vehicle, bicycle. or other conveyance of any sort is hereby required to bring their motor vehicle, bicycle or other conveyance to a complete stop before entering the "through" or "preferential" street, and to yield the right of way on the traffic on the "through" or "preferential" street.

(o)    Except where otherwise posted the speed limits within the corporate limits of the Town of Kentland are as specified by the laws of the State of Indiana, namely: Twenty (20) miles per hour in the business district and Thirty (30) miles per hour in any residential district.

(p)    Any person who violates any of the provisions of this Section shall upon conviction or a plea of guilty be subject to a fine or penalty of three dollars ($3.00).

(q)    The Town Marshal and all other duly authorized law enforcement officers charged with the enforcement of this Section may issue an appearance ticket directing said offender to appear before the Clerk-Treasurer of the Town of Kentland by a specified date. Anyone so notified to appear for a violation of this Section may pay the fine or penalty of three dollars ($3.00) direct to the Clerk-Treasurer of the Town, who shall give the offender a receipt showing payment thereof. If said alleged offender does not wish to admit a violation of this Section and voluntarily pay the penalty to the Clerk-Treasurer, then charges shall be preferred by the arresting officer for the violation.

(r)    All funds collected under this Section by the Clerk-Treasurer shall be duly recorded in a separate record hook and all money collected shall be turned into the General Fund of the Town of Kentland.

Sec. 8-26    Alley Regulations

(a)    All vehicles traveling upon and using the alleys shall yield the right-of-way to vehicles traveling upon any street, and shall come to a complete stop before entering from the alley into any street, provided that stop signs shall not be required to be posted at the approaches to alley exits.

(b)    Vehicles shall not be parked at any time in any alley so as to block and prevent the use of the alley by other vehicles so as to make it impassable.

(c)    Violators of this Section shall be fined in any sum not exceeding ten dollars ($10.00).

Sec. 8-27    Speed Zones on U.S. Highway #24

(a)    The Town Board of Trustees believes it is in the interest of public safety to designate the rates of speed on U.S. Highway #24 as it passes through Town, as well as mark school zones.

(b)    The following speed and school zones shall be appropriately marked:

1.     U.S. Highway #24 beginning at the West corporation line and to the site of the Cassidy Garage be marked for a Forty (40) mile speed zone.

2.     U.S. Highway #24 from the Cassidy Garage to the New York Central Railroad tracks be marked for a Thirty (30) mile speed zone.

3.     U.S. Highway #24 be marked from the New York Central Railroad tracks to Fourth Street as a Twenty (20) miles speed zone.

4.     U.S. Highway #24 be marked from Fourth Street to the intersection of U.S. Highway #41 as a Thirty (30) miles speed zone.

5.     U.S. Highway #24 be marked from U.S. Highway #41 to the East Corporation line as a Forty (40) mile speed zone.

6.     U.S. Highway #24 be marked as a School Zone or School Crossing at the approaches of said Highway to First Street.

Sec. 8-28    Bridge Load Limits

(a)    The Town Board of Trustees, upon recommendation of the Town Engineer and Chief of Police, believe it is necessary and in the public to establish load limits for bridges.

(b)    The Bridge over the Kent Ditch on Dunlap Street between Fourth Street and Fifth Street shall not exceed five thousand (5,000 pounds gross weight. The bridge shall be posted with appropriate signs at the corner of Fourth Street and Dunlap Street and at the corner of Fifth Street and Dunlap Street.

(c)    Violators of this Section shall be fined ten dollars ($10.00).

WHEREAS, General Ordinance No. 206 as enacted by the Board of Trustees in 1940, and as codified as Section 8-22 of the General Ordinances of the Town of Kentland in July, 1983, limits the parking of trucks, trailers, tractors, tractor-trailers and house trailers on the streets within the Town of Kentland; and WHEREAS, the Town Council desires to amend Ordinance 8-22 to further restrict the parking of large and heavy vehicles including semi-trailers, tractors or combined units, or any vehicle with a gross weight exceeding 13,000 pounds, GVW, on any public street or alley within the corporate limits; and WHEREAS, the Town Council deems it necessary for the protection of the town roadways and streets to completely eliminate the parking of any semi-trailer, tractor or combined units, or any vehicle with a gross weight exceeding 13,000 pounds GVW, on any public street or alley within the corporate limits of the Town of Kentland, Newton County, Indiana, with the following exceptions:

1. It shall be permissible to park such vehicle on the Town of Kentland streets and roadways for a period not to exceed one (1) hour, provided that the purpose of such parking is to load or unload cargo, if such vehicle parking does not unduly obstruct traffic.

2. It shall be lawful to park such vehicle in areas specifically designated and marked for such parking by the Town Council.

NOW, THEREFORE, be it duly ordained as follows: Section 8-22 of the General Ordinances for the Town of Kentland limiting the parking of trucks, trailers, tractors, tractor-trailers and house trailers is hereby amended to read as follows:

Section 8-22(a). It shall be unlawful to park any semi-trailer, tractor, or combined unit, or any vehicle with a gross weight exceeding 13,000 pounds GVW, on any public street or alley within the corporate limits of the Town of Kentland, Newton County, Indiana, with the following exceptions:

It shall be permissible to park such vehicle on the Town of Kentland streets and roadways for a period not to exceed one (1) hour, provided that the purpose of such parking is to load or unload cargo, and such vehicle parking does not unduly obstruct traffic.

2. It shall be lawful to park such a vehicle within the Town of Kentland in areas specifically designated and marked for such parking by the authority of Kentland Town Council.

Section 8-22(b). Any person or persons, firms or corporations who shall violate the provisions of this Ordinance 8-22, as amended, shall be deemed guilty of a Class C Infraction and may be fined up to $500.00 per day.

The Town Marshal and all other duly authorized law enforcement officers charged with the enforcement of this Article Ordinance 8-22, as amended, may arrest anyone that violates the provisions of this Ordinance and prefer charges hereunder in the Newton Superior Court, or may issue an Appearance Ticket directing said offender to appear before the Newton Superior Court.

This amendment to Ordinance 8-22 shall become effective immediately after publication in the Newton County Enterprise for a period of two (2) successive weeks.

All of which is duly ordained this 9th day of August, 1993.
